Terms of Service
These Terms of Service ("Terms") govern your use of the ScreenGeany AI desktop application and related services ("Service") operated by Ayelite Technologies Private Limited ("Company", "we", "us", "our"), a company incorporated in India. By downloading, installing, or using ScreenGeany AI, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
ScreenGeany AI is a desktop application for macOS (and Windows, when available) that captures your screen on demand and sends the image to a third-party AI provider (Anthropic or OpenAI) to generate context-aware answers. The Service includes:
- The ScreenGeany AI desktop application
- The cloud proxy that routes AI requests (Cloudflare Workers)
- The account, authentication, and usage tracking system (Firebase)
- The subscription and billing system (currently via Razorpay; Paddle may be used as an additional or alternative payment processor)
- The website at screengeany.ai
The Service is a productivity tool. It is not a substitute for professional advice (legal, medical, financial, or otherwise). AI-generated outputs should always be independently verified before being relied upon.
2. Eligibility
You must be at least 13 years old (or 16 in jurisdictions where a higher age of digital consent applies) to use ScreenGeany AI. By creating an account, you confirm that you meet this age requirement and have the legal capacity to enter into these Terms.
If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and "you" refers to both you individually and the organisation.
3. Accounts
3.1 Registration
You must create an account to use ScreenGeany AI. You can sign in with Google or register with an email address and password. Email/password accounts require email verification before access is granted.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at hi@screengeany.ai if you suspect any unauthorised access to or use of your account.
3.3 One Account Per Person
Each account is for a single individual. You may not share your account credentials with others or create multiple accounts to circumvent usage limits or obtain additional free queries.
4. Plans and Pricing
4.1 Free Plan
The Free plan includes 10 AI queries per calendar month at no charge. Queries reset on the first day of each month. No payment information is required for the Free plan.
4.2 Lite Plan
The Lite plan is a paid monthly subscription. Pricing may vary by region and is displayed at checkout. The Lite plan includes:
- 75 queries per calendar month
- Full-screen screenshot capture
- All Free plan AI models
- Custom global hotkey configuration
- Launch on startup and always-on-top options
The Lite plan does not include Bring Your Own Key (BYOK) or Active Window screenshot capture mode. These features are available exclusively on the Pro plan.
4.3 Pro Plan
The Pro plan is a paid monthly subscription. Pricing may vary by region and is displayed at checkout. The Pro plan includes:
- 200 queries per calendar month
- Bring Your Own Key (BYOK) for unlimited queries
- Active Window screenshot capture mode
- Custom global hotkey configuration
- Launch on startup and always-on-top options
4.4 Bring Your Own Key (BYOK)
Pro subscribers may add their own Anthropic or OpenAI API key. When a BYOK key is active, the monthly query limit no longer applies — queries are sent directly using your API key. You are solely responsible for any charges incurred on your API provider account. We do not monitor, cap, or control your BYOK usage or spending. We are not liable for any costs arising from your API key usage.
4.5 Payment Processors
Payments are processed by Razorpay and/or Paddle. We do not store your payment card details.
Where Paddle is the payment processor, Paddle acts as the Merchant of Record. This means Paddle is the legal seller of your subscription and is responsible for billing, tax collection (VAT, GST, sales tax), invoicing, and processing refunds. Your purchase through Paddle is also subject to Paddle's Buyer Terms.
Where Razorpay is the payment processor, Ayelite Technologies Private Limited is the seller and Razorpay processes payments on our behalf.
4.6 Billing
Subscriptions are billed monthly on the date of initial purchase. You authorise recurring charges to your payment method until you cancel. All prices are inclusive of applicable taxes unless stated otherwise at checkout.
4.7 Cancellation
You may cancel your Pro subscription at any time from Settings within the app, or through your payment processor's portal. Cancellation takes effect at the end of the current billing period — you retain Pro access until that date. No partial-month refunds are provided, except where required by applicable law.
4.8 Refunds
Where Paddle is the Merchant of Record, refund requests are handled according to Paddle's refund policy. For Razorpay transactions, if you believe you were charged in error, contact us at hi@screengeany.ai within 14 days of the charge.
4.9 Price Changes
We may change the Pro plan price with at least 30 days' notice by email or in-app notification. The new price will apply from your next billing cycle after the notice period. If you do not agree to the new price, you may cancel before it takes effect.
4.10 Taxes
Where Paddle acts as Merchant of Record, Paddle is responsible for calculating and remitting applicable taxes. For all other transactions, you are responsible for any applicable taxes unless we are legally required to collect them.
5. Acceptable Use
5.1 Permitted Use
You may use ScreenGeany AI for any lawful personal or professional purpose, including but not limited to debugging code, analysing documents, understanding UI designs, drafting text, translating content, and any other task where asking an AI about your screen is helpful.
5.2 Prohibited Use
You must not use ScreenGeany AI to:
- Capture or process screens containing content that violates applicable laws
- Capture screens of other people without their knowledge or consent
- Process content that infringes on third-party intellectual property rights
- Attempt to reverse-engineer, decompile, disassemble, or extract source code from the app
- Circumvent, disable, or interfere with any security, authentication, or quota mechanisms
- Create multiple accounts to obtain free queries beyond the stated limit
- Use automated tools, bots, or scripts to access the Service
- Resell, sublicense, or provide the Service to third parties without our written consent
- Use the Service in any manner that violates the terms of your AI provider (Anthropic or OpenAI)
- Use the Service to generate content that is unlawful, harmful, threatening, abusive, defamatory, or discriminatory
- Attempt to probe, scan, or test the vulnerability of the Service or breach security measures
- Interfere with or disrupt the Service or its infrastructure
5.3 AI Provider Terms
Your use of Claude (via Anthropic) or GPT-4o (via OpenAI) through ScreenGeany AI is also governed by those providers' respective terms of service and usage policies. You are responsible for complying with their terms. Violations of AI provider terms may result in suspension or termination of your ScreenGeany AI account.
5.4 Enforcement
We reserve the right to investigate and take appropriate action against violations of these Terms, including suspending or terminating accounts, reporting illegal activity to law enforcement, and cooperating with legal proceedings.
6. Intellectual Property
6.1 Our Property
ScreenGeany AI, including its design, source code, branding, trademarks, documentation, and all related materials, is the property of Ayelite Technologies Private Limited. Nothing in these Terms grants you ownership of the Service or any intellectual property rights in it beyond the limited licence granted below.
6.2 Your Content
You retain full ownership of everything on your screen and all content you submit to AI providers through the Service. We do not claim any rights over your screenshots, questions, or the AI responses you receive. We do not store your questions or AI responses — they are processed in-flight and discarded. You grant us no licence to use your content except as strictly necessary to provide the Service (i.e. transmitting your query to the AI provider and returning the response).
6.3 AI-Generated Output
AI-generated responses are produced by third-party providers (Anthropic, OpenAI). Ownership and usage rights to AI output are subject to the respective AI provider's terms. To the extent permitted by law and by the applicable provider's terms, you may use AI output for your own purposes.
6.4 Licence to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the ScreenGeany AI application on devices you own or control, solely for your personal or internal business use. This licence does not include the right to modify, distribute, or create derivative works of the application.
6.5 Feedback
If you provide us with feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, royalty-free licence to use such feedback for any purpose without obligation to you.
7. Privacy
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the data practices described therein.
8. Third-Party Services
The Service relies on third-party services including Anthropic, OpenAI, Firebase, Cloudflare, Razorpay, and Paddle. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service. Outages or changes in third-party services may affect the functionality of ScreenGeany AI, and we shall not be liable for any such disruptions.
9. Disclaimers
9.1 AI Output
AI responses generated through ScreenGeany AI are produced by third-party AI providers and may be inaccurate, incomplete, misleading, or inappropriate. You are solely responsible for evaluating, verifying, and acting on any AI-generated output. Do not rely on AI responses for medical, legal, financial, safety-critical, or other professional decisions. The Company is not liable for any actions taken or decisions made based on AI output.
9.2 Service Availability
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not guarantee uninterrupted, error-free, or secure operation of the Service.
9.3 Screenshot Permission
ScreenGeany AI requires screenshot permission on macOS (listed as "Screen Recording" in System Settings). The app does not continuously record your screen — it captures a single screenshot only when you press the hotkey. You grant this permission voluntarily through your operating system's privacy controls. You are responsible for ensuring you have the right to capture any content displayed on your screen, including content belonging to third parties or subject to confidentiality obligations.
9.4 No Professional Advice
Nothing provided through the Service constitutes professional, legal, medical, financial, or other specialised advice. Always consult a qualified professional for decisions in those domains.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Ayelite Technologies Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, business opportunities, or goodwill — arising from your use of or inability to use the Service, even if advised of the possibility of such damages.
- Our total aggregate liability to you for any and all claims arising from or related to the Service shall not exceed the greater of: (a) the total amount you paid us in the 12 months preceding the claim, or (b) fifty US dollars ($50 USD).
- We are not liable for any damages arising from: (a) AI-generated content; (b) your use of BYOK and associated API charges; (c) unauthorised access to your account due to your failure to maintain credential security; (d) third-party service outages or failures.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Ayelite Technologies Private Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Content you submit through the Service
- Your use of BYOK and any resulting charges or liabilities with AI providers
12. Termination
12.1 By You
You may stop using the Service at any time. To cancel your subscription, use Settings within the app or your payment processor's portal. To delete your account and all associated data, email hi@screengeany.ai with the subject "Delete My Account".
12.2 By Us
We may suspend or terminate your access to the Service immediately if you violate these Terms, engage in abusive behaviour, or if we are required to do so by law. For other reasons (e.g. discontinuation of the Service), we will provide at least 30 days' notice where practicable.
12.3 Effect of Termination
Upon termination: (a) your licence to use the app ends immediately; (b) you must uninstall the application; (c) we may delete your account data in accordance with our Privacy Policy and data retention obligations; (d) any outstanding payment obligations survive termination; (e) sections of these Terms that by their nature should survive (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall continue in effect.
13. Updates & Modifications to the Service
We may update, modify, or discontinue features of the Service at any time. The desktop application may automatically check for and install updates. We will endeavour to provide notice of material changes but are not obligated to maintain any specific feature or functionality.
14. Governing Law & Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
14.2 Dispute Resolution
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
14.3 Exceptions
Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy and any applicable payment processor's terms, constitute the entire agreement between you and Ayelite Technologies Private Limited regarding the Service.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
15.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
15.5 Force Majeure
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet or infrastructure failures, or third-party service outages.
15.6 Notices
We may send notices to you via email (to the address associated with your account) or through in-app notifications. You may send notices to us at hi@screengeany.ai.
